Assessment Certificates
In accordance with the law, a class II legal advertisement which listed the structures affected by the project (as determined by the initial study) which included the Phase, Structure Number, Name and Address of the Last Known Owner, District, Tax Map, and Parcel Number, Square Footage, and Assessment Amount (estimated 5% cost plus the CIAD Fee) was published in the Welch Daily News and the Iaeger Industrial News in November 1999 and gave landowners 30 days in which to withdraw from the project without charge. The notice instructed individuals who did not want to participate to notify the County Commission in writing by December 28, 1999 that they did not wish to participate, in order to withdraw (opt-out) from the project free of charge. A public meeting was held on December 28, 1999 at the Mt. View High School in Welch to answer questions about the project and to allow those individuals which elected not to participate in the project to opt-out free of charge. Owners of the affected property who did not notify the County Commission in writing by the deadline that they did not wish to participate were included in the project and an Assessment Certificate issued for the landowner's estimated cost (estimated 5% cost plus the CIAD Fee). The Assessment Certificate is then Modified by Resolution of the CIAD Board when the Actual Total Cost has been determined (upon completion of floodproofing, acquisition, or withdrawal from the project by the landowner) to reflect 5% of the Actual Total Cost plus the CIAD Fee. These liens are an assessment, similar in nature to a paving or sidewalk lien, and represent the lien of a special district. The liens are in a superior position to previously filed deeds of trust, and are subordinate only to tax liens from County Real Estate Tax and Federal Tax Liens. Landowner’s Cost
For Floodproofing: The Landowner’s Cost will include the CIAD Fee plus 5% of the U.S. Army Corps of Engineer’s (USACE) total cost to floodproof the structure. The USACE’s total cost for Floodproofing includes Actual Construction Cost and Administrative Fees. Administrative fees for floodproofing a structure include, but are not limited to, fees for checking titles, design (guide plans and specification), asbestos investigation, and construction inspection(s), etc.
For Acquisition: The Landowner’s Total Cost will include the CIAD Fee plus 5% of the USACE`s total cost to purchase the structure. The USACE’s total cost to Purchase includes Actual Cost to Purchase Property and Administrative Fees. Administrative Fees for Purchasing a structure include but are not limited to fees for appraisals, monumentation, mapping, checking for asbestos, checking titles, relocation assistance, demolition costs, etc.

Cost to Withdraw From the Project
Any landowner included in the project which withdraws participation from (opts-out of) the program will be charged the CIAD Fee (currently $300.00) plus 5% of the U.S. Army Corps of Engineers Administrative Cost incurred (if applicable) up to the time that a withdrawal in writing has been received.Failure to complete a right-of-entry application to the Corps of Engineers upon completion of the project constitutes withdrawal from the project, and applicable fees will be charged accordingly.
